Acceptable Use Policy
Introduction
This Acceptable Use Policy (“AUP”) governs all use of the SureContact platform, including its email marketing, automation, CRM, landing page, and related services. By accessing or using SureContact, you agree to comply fully with this AUP.
Violations of this policy may result in immediate account suspension or termination without prior notice. SureContact reserves the right to modify this AUP at any time.

Note: This document forms part of your agreement with SureContact. It may be updated periodically. Continued use of the platform after changes constitutes acceptance of the revised policy.
1. Email Sending Guidelines
All email activity on SureContact must adhere to the following performance thresholds. Accounts that consistently exceed these limits will be reviewed and may be suspended.

Subscriber Consent
You must obtain clear, provable, and affirmative consent from every recipient before sending non-transactional emails. Consent must be collected through single or double opt-in with unambiguous language.
- Opt-in checkboxes must not be pre-checked by default — whether on online or offline forms.
- You must be able to demonstrate consent upon request, including the email address, the date obtained, and the collection method.
- Purchased, rented, scraped, or third-party lists are strictly prohibited.
Unsubscribe & Opt-Out
Every non-transactional email sent through SureContact must include a clearly visible and functional unsubscribe link.
- The unsubscribe mechanism must be immediate — opt-out requests must be honored within 10 business days.
- Link anchor text must accurately describe its purpose; misleading opt-out labels are prohibited.
- You must not contact an unsubscribed recipient for any marketing purpose after their opt-out.
Sender Identification
Every email must clearly identify the sender. The following fields are required and must be accurate:
- From: Display name and email address
- Reply-To: A valid, monitored reply address
- Physical mailing address of the sender (required by CAN-SPAM, CASL, and GDPR)
If sending on behalf of a third-party brand or partner domain, you must disclose this in the email body. All third-party sending domains must be verified within SureContact.
Domain & Website Requirements
You must have an active, publicly accessible website associated with the sending domain verified in your SureContact account. The website must include a published and legally compliant privacy policy.
2. Prohibited Use
SureContact may restrict or terminate your account for any activity we deem harmful, unlawful, or abusive. The following are examples of prohibited activities:
Sending & Deliverability Abuse
- Sending emails to lists obtained from third parties, purchased, rented, or scraped
- Using email verification or validation tools to test unsubscribed or non-opted-in addresses
- Generating, harvesting, or probing email addresses to determine existence
- Forging or omitting sender information, return paths, or IP addresses
- Sending emails designed to bypass spam filters through obfuscation or deceptive formatting
- Conducting phishing, spoofing, or impersonation campaigns
Platform & Infrastructure Abuse
- Consuming a disproportionate share of platform resources that impairs other users
- Uploading or transmitting viruses, malware, or corrupted code
- Attempting unauthorized access to SureContact systems, accounts, or infrastructure
- Reverse engineering, decompiling, or interfering with the platform’s code or APIs
- Using automated scripts or bots to interact with SureContact in ways that degrade service
Legal & Regulatory Violations
- Any activity that violates applicable laws, including CAN-SPAM, CASL, GDPR, or local email regulations
- Sending unsolicited commercial email (spam) in any jurisdiction
- Violating data protection, privacy, or anti-spam regulations
- Engaging in deceptive trade practices or violating consumer protection law
3. Prohibited Content
SureContact prohibits content that is unlawful, harmful, deceptive, or that we reasonably believe poses a threat to recipients, the public, or our platform. You may not publish, store, transmit, or link to content that promotes or relates to:
Illegal or Harmful Content
- Illegal drugs, controlled substances, or drug paraphernalia
- Weapons, firearms, or ammunition that violate applicable law
- Counterfeit goods, pirated software, or intellectual property infringement
- Content that facilitates or promotes illegal activity of any kind
Adult & Explicit Content
- Pornography, explicit sexual content, or content of a sexually suggestive nature
- Content that exploits, endangers, or sexualizes individuals under 18 years of age
- Escort or adult entertainment services
Violence, Hate & Harassment
- Content that incites, glorifies, or threatens violence against any person or group
- Hate speech targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
- Harassment, cyberbullying, or targeted abuse of individuals
- Content that promotes extremist ideologies or terrorism
Deceptive & Fraudulent Content
- Phishing, scam, or fraud-enabling content
- Pyramid schemes, multi-level marketing of dubious legality, or chain letters
- False claims about products, services, or endorsements
- Misleading health claims or unverified medical treatments
- Get-rich-quick schemes or predatory financial offers
Regulated Industries
SureContact may impose additional requirements or restrictions on senders in the following industries. Contact support before sending:
- Financial services, investment advice, or cryptocurrency offerings
- Gambling, wagering, or lottery promotions
- Debt collection or high-interest lending products
- Pharmaceutical, CBD, or health supplement products making medical claims
- Affiliate marketing where the sender does not have a direct relationship with the product
4. Data & Privacy Obligations
You are solely responsible for the data you collect, store, and process using SureContact. You must:
- Publish and maintain a legally compliant privacy policy on your website
- Comply with all applicable data protection laws including GDPR, CCPA, and local equivalents
- Not collect personal data from minors without appropriate parental consent
- Promptly honor all data subject access, correction, and deletion requests
- Safeguard any personally identifiable information (PII) uploaded to or generated within SureContact
- Not share, sell, or transfer subscriber data to unauthorized third parties
5. Enforcement & Account Actions
SureContact monitors platform activity to maintain deliverability, security, and service quality. When violations are detected, we may take the following actions:
Graduated Response
- Warning: Written notice with a required remediation period
- Suspension: Temporary restriction of sending privileges pending investigation
- Termination: Permanent account closure for serious or repeated violations
- Legal referral: Reporting to law enforcement for criminal activity
Immediate Termination
The following violations will result in immediate account termination without warning:
- Sending to purchased, rented, or scraped lists
- Spam complaint rates exceeding 0.3%
- Distribution of malware, phishing content, or illegal material
- Any activity that poses an immediate risk to the safety of the platform or its users
Appeals
If you believe your account was suspended in error, you may submit an appeal to our team at [email protected]. Appeals are reviewed within 5 business days. SureContact’s determination is final.
6. Reporting Violations
If you believe another SureContact user is violating this AUP, please report it to our support team.
While Users’ right to take legal action shall always remain unaffected, in the event of any concern regarding misuse of this platform, Users are kindly asked to contact the Owner at the contact details provided in this document.
The Owner will process the complaint without undue delay and within 7 days of receiving it.
